1. Agreement to these Terms
These Terms of Service ("Terms") are a contract between you and Edden Internet Private Limited ("Rox," "we," "us," or "our"). They govern your use of the Rox mobile app, our website at talktorox.com, and related services (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 16 years old to use Rox. If you are between 16 and 18, or under the age of majority where you live, you may use Rox only with the involvement and permission of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service, you confirm that you meet these requirements and are able to enter into this agreement, or that your parent or guardian has agreed to it for you.
3. What Rox is, and what it is not
Rox is an AI-powered companion that offers supportive conversation, reflection, and self-management tools for people living with chronic conditions. Rox can help you track patterns, pace your energy, and feel less alone.
Rox is not a medical service. This is the most important thing to understand:
Rox does not provide medical advice, diagnosis, or treatment.
Rox is not a doctor, therapist, nurse, or licensed healthcare professional, and using Rox does not create a provider-patient relationship.
Anything Rox says is for informational and supportive purposes only. It is not a substitute for professional medical advice. Always consult a qualified healthcare provider about your health and before making any decision about your care, medications, or treatment.
Recovery scores, pacing insights, and similar features are estimates to support reflection. They are not clinical measurements and should not be relied on for medical decisions.
Rox is not for emergencies. If you are experiencing a medical emergency, call 911 or your local emergency number. If you are in crisis or thinking about harming yourself, call or text 988 (the Suicide and Crisis Lifeline in the US) or go to the nearest emergency room. Rox cannot and will not provide emergency or crisis intervention.
4. Your account
You are responsible for keeping your login credentials secure and for activity that happens under your account. Let us know promptly at founders@talktorox.com if you suspect unauthorized use. We may suspend or close accounts that violate these Terms.
5. Subscriptions, billing, and cancellation
Some features may require a paid subscription.
Billing through the App Store. Subscriptions purchased in the app are billed through your Apple App Store account, and are subject to Apple's terms. We do not process those payments directly.
Auto-renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. Your account will be charged for renewal within 24 hours before the period ends, at the then-current price.
Managing and cancelling. You manage and cancel your subscription in your Apple App Store account settings. Deleting the app does not cancel your subscription.
Free trials. If we offer a free trial, any unused portion is forfeited when you purchase a subscription. Trials may convert to paid subscriptions automatically unless you cancel before the trial ends.
Refunds. All purchases are made through the Apple App Store, and refunds are handled according to Apple's policies.
Price changes. We may change subscription prices. We will give you notice as required, and changes will not apply to the current paid period.
6. Acceptable use
You agree not to:
Use the Service for anything unlawful, harmful, or fraudulent.
Try to access another user's account or data.
Reverse engineer, scrape, or attempt to extract the underlying models or source code, except where the law expressly permits it.
Interfere with or disrupt the Service or its security.
Use the Service to build a competing product or to train a competing model.
Misrepresent Rox's outputs as professional medical advice to others.
7. Your content
You own the content you share with Rox, including your messages and the health information you choose to provide ("Your Content"). You grant us a limited, non-exclusive license to host, store, process, and use Your Content as needed to operate and provide the Service to you, as described in our Privacy Policy.
We do not claim ownership of Your Content, and we handle the health information within it according to our Privacy Policy and our Consumer Health Data Privacy Policy. We do not use the content of your conversations to train foundation models, and our AI providers are bound by terms that prohibit them from training on your content.
8. AI-generated content
Rox uses artificial intelligence to generate responses. AI can be wrong, incomplete, or out of date, and it can produce content that sounds confident but is inaccurate. You are responsible for how you use Rox's outputs, and you should not rely on them for medical, legal, financial, or other professional decisions. See the medical disclaimer in Section 3.
9. Intellectual property
The Service, including the Rox name, logo, design, software, and content we create, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive license to use the Service for your own personal, non-commercial use, subject to these Terms. We reserve all rights not expressly granted.
10. Third-party services
The Service works with third parties such as the Apple App Store, Apple Health, and wearable platforms like Oura and Whoop. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.
11. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any output will be accurate or reliable. To reiterate Section 3, the Service is not medical advice and is not a substitute for professional care.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, Edden Internet Private Limited and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service.
To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of one hundred US dollars ($100) or the amount you paid us in the twelve months before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Indemnification
You agree to indemnify and hold harmless Edden Internet Private Limited from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or of any law or third-party right.
14. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination, such as content licenses already used, disclaimers, limitation of liability, and dispute resolution, will survive.
15. Dispute resolution and governing law
These Terms are governed by the laws of India, and you agree to the jurisdiction of the courts in Surat, Gujarat, India for any dispute not subject to arbitration below, except where the mandatory consumer protection or health-privacy laws of your US state of residence give you rights that apply regardless of this choice. Those laws, such as the Washington My Health My Data Act and the California CCPA, can still apply to you even though Rox is operated from India.
Binding arbitration and class action waiver. To the fullest extent permitted by law, you and Rox agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration rather than in court, except that either party may bring a qualifying claim in small claims court. The arbitration will be administered by a recognized arbitral body under its consumer arbitration rules, seated in the United States or conducted by remote means convenient to you. You and Rox waive the right to a jury trial and waive any right to bring or participate in a class action or class-wide arbitration. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing founders@talktorox.com with "Arbitration Opt-Out" in the subject line. This section does not prevent a government regulator or attorney general from bringing an action against Rox. [Your attorney should confirm the arbitral body and seat and the clause's enforceability for US consumers given the Indian operating entity. If you would rather keep things simple for now, this entire arbitration block can be deleted, leaving only the governing-law paragraph above.]
16. Apple App Store terms
If you download Rox from the Apple App Store, the following also applies:
These Terms are between you and Rox only, not with Apple. Apple is not responsible for the Service or its content.
Apple has no obligation to provide maintenance or support for the Service.
If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price if any; to the maximum extent permitted by law, Apple has no other warranty obligation regarding the Service.
Apple is not responsible for addressing any claims relating to the Service, including product liability, legal or regulatory compliance, or consumer protection claims.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You confirm you are not located in a country subject to a US Government embargo and are not on any US Government restricted-parties list.
17. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email and update the "Last updated" date. Continuing to use the Service after changes take effect means you accept the updated Terms.
